The Ontario paralegal licensing exam

The format

• 160 multiple-choice questions, each with four options and one best answer.
• 4 hours and 30 minutes, so a little under 1 minute 45 seconds per question.
• Open book with print materials only. No digital materials in the testing area.
• Written in English or French.
• A mix of stand-alone questions and short case scenarios, each followed by several questions.
• Marked pass or fail on one overall score. There is no penalty for a wrong answer.

What it covers

The Law Society's paralegal competencies cover ethical and professional responsibilities, Canadian law, civil litigation, administrative law, criminal and quasi-criminal law and procedure, alternative dispute resolution, the litigation process and practice management. Our questions are grouped into five areas:

• Professional Responsibility: the Paralegal Rules of Conduct, trust accounting, supervision and running a practice.
• Civil Litigation: Small Claims Court procedure, limitation periods, service, defaults, settlement conferences and enforcement.
• Criminal and Quasi-Criminal: Provincial Offences Act proceedings and the summary conviction matters paralegals may handle.
• Administrative Law: tribunal practice, including the Landlord and Tenant Board, the Human Rights Tribunal and workplace insurance appeals.
• Canadian Law: the courts, sources of law, the Constitution and the Charter.
• Alternative dispute resolution and the litigation process are tested inside the area they belong to.

Are these the real exam questions?

No. They are practice questions written to the same format by Ontario lawyers, paralegals and paralegal instructors. They are not Law Society questions.

Should I write a full exam timed?

At least once, about a week before the exam. Untimed is better earlier, while you are still building your tabs and index.
