Question 1
Twenty days after receiving your client's written request for her hospital chart, an Ontario hospital tells her it needs more time because the records are voluminous. Under the Personal Health Information Protection Act, 2004, the hospital:
A.May extend the time by not more than 30 days, by written notice giving the length of and reason for the extension.
B.May extend the time by not more than 60 days, by written notice giving the length of and reason for the extension.
C.May extend the time by not more than 30 days, but only with the Information and Privacy Commissioner's approval.
D.Cannot extend the time, and must respond within 30 days of receiving the request.
Show answerHide answer
Answer: A. May extend the time by not more than 30 days, by written notice giving the length of and reason for the extension.
The hospital must respond within 30 days (s. 54(2)), but within that period it may extend the time by not more than 30 days where meeting the limit would unreasonably interfere with its operations because the information is extensive or needs a lengthy search (s. 54(3)(a)). It must give written notice of the length of and reason for the extension (s. 54(4)). (B) The extension is capped at 30 days, not 60. (C) The custodian extends on its own notice; the Commissioner's approval is not required. (D) Section 54(3) permits one extension for voluminous records, so the 30-day limit is not absolute.
Question 2
An appeal to the Court of Appeal for Ontario raises whether an Ontario statute restricting election advertising infringes s. 2(b) of the Canadian Charter of Rights and Freedoms. A civil liberties association that is not a party wants to file a factum and make oral argument. Which of the following is correct?
A.It may intervene only as an added party, and only if it shows that the judgment may adversely affect it.
B.It may intervene without leave, because any appeal raising a Charter question is open to public interest groups.
C.It may intervene once it serves a notice of constitutional question on the Attorneys General of Canada and Ontario.
D.It needs leave, which a panel of the court, the Chief Justice of Ontario or a designated judge may grant.
Show answerHide answer
Answer: D. It needs leave, which a panel of the court, the Chief Justice of Ontario or a designated judge may grant.
Rule 13.03(2) of the Rules of Civil Procedure provides that leave to intervene in the Court of Appeal, as an added party or as a friend of the court, may be granted by a panel of the court, the Chief Justice or Associate Chief Justice of Ontario, or a judge designated by either of them. (B) No non-party intervenes without leave; only the Attorneys General have a statutory right to be heard on a constitutional question (Courts of Justice Act, s. 109(4)). (C) A notice of constitutional question under s. 109(1) goes to the Attorneys General and gives them, not the association, a right to be heard. (A) Rule 13.02 also permits intervention as a friend of the court, without becoming a party, to assist the court by argument; the interest criteria in rule 13.01(1) apply to added parties.
