Answer: B. The writ expires on March 1, 2027 unless a request to renew it is filed with the sheriff before then.
Under r. 60.07(6) of the Rules of Civil Procedure, a writ of seizure and sale expires on the sixth anniversary of its issue, here March 1, 2027, unless renewed. A writ filed with the sheriff is renewed before it expires by filing a request to renew (Form 60E) with the sheriff (r. 60.07(8)), and each renewal runs for a further six years. (A) The writ does not last until payment; it lapses at six years unless renewed (r. 60.07(6)). (C) Renewal is available under r. 60.07(8) and (9), so the creditor need not sue again on the judgment. (D) Renewal is an administrative filing with the sheriff, or with the registrar for a writ not filed with a sheriff (r. 60.07(9)); no motion is required.
Question 2
Justice Lee conducted the pre-trial conference in your client's action, which did not settle. The trial office has now scheduled the trial before Justice Lee. Which of the following is correct?
A.Justice Lee may preside at the trial unless a party moves to have another judge assigned.
B.Justice Lee may preside at the trial only if all parties consent in writing.
C.Justice Lee may not preside at the trial, even if all parties consent in writing.
D.Justice Lee may preside at the trial if the pre-trial report records no settlement discussion.
Show answerHide answer
Answer: B. Justice Lee may preside at the trial only if all parties consent in writing.
Under rule 50.10(1) of the Rules of Civil Procedure, a judge who conducts a pre-trial conference shall not preside at the trial except with the written consent of all parties. Unless you and the other parties consent in writing, the trial must go before another judge. (A) The bar applies automatically; no party has to move to enforce it. (C) Written consent of all parties lifts the bar under rule 50.10(1). (D) What the pre-trial conference report records goes to the separate rule against disclosing pre-trial statements to the trial judge (r. 50.09); it does not permit the pre-trial judge to preside without consent.
